These Terms & Conditions (“Terms”) govern your access to and use of the Cappybara platform at https://cappybara.pro operated by Cappybara, LLC.
By accessing or using the Services, you agree to these Terms.
Please be aware, if you do not agree, you cannot use the Cappybara Service.
1. Definitions
- “Creator” means a user who creates a page/project, publishes content, offers memberships, sells digital content, or receives support.
- “Supporter” means a user who provides financial support to a Creator (for example, tips, donations, memberships, or purchases).
- “Content” means text, images, audio, video, links, and other materials posted or made available through the Services.
- “User Content” means Content submitted by users (Creators or Supporters).
2. Eligibility and accounts
- You must be at least 18 years old (or the age of majority where you live) to create an account or make payments.
- You are responsible for all activity on your account and for keeping your login credentials secure.
- You agree to provide accurate, complete, and up-to-date information and not to impersonate others.
- We may suspend or terminate accounts that violate these Terms or applicable law.
3. What Cappybara is (and is not)
Cappybara provides tools for Creators to present their work and receive support from Supporters. Cappybara does not create, own, or endorse Creator Content, and is not a party to the relationship between Creators and Supporters.
We may review content and activity for safety, fraud prevention, and compliance purposes, and we may enforce these Terms and our policies at our discretion.
4. Payments, fees, and payouts
4.1 Payment processing
Cappybara is partnered with Stripe for payment processing. When you support or create a page, you’re also agreeing to the payment processor’s terms of service.
4.2 Platform fees
Creating an account on Cappybara is free. If you publish content or projects that receive financial support, Cappybara (together with its payment partners) may collect applicable fees. Payment processing fees may vary depending on the payment method and your location. Each payment provider operates independently, and Cappybara is not responsible for the performance of third-party payment services. You are responsible for any additional fees, charges, or taxes associated with your use of the Platform.
4.3 Payout timing and reserves
Payouts to Creators are not necessarily instant. We may delay, withhold, or place a reserve on funds to:
- conduct fraud or risk reviews,
- address disputes, chargebacks, or refunds,
- comply with law or payment-partner requirements (including Stripe requirements),
- enforce these Terms or related policies.
4.4 Taxes
You are responsible for determining and paying any taxes applicable to your use of the Services. Creators are responsible for any taxes due on amounts they receive.
5. Refunds, disputes, and chargebacks
- Supporters should first contact the Creator regarding issues with benefits, content, or delivery (if applicable).
- We may issue refunds at our discretion, including in cases of suspected fraud, unauthorized transactions, or policy violations.
- We monitor disputes and chargebacks. Creators with excessive disputes may be suspended or removed.
6. Creator onboarding and verification (KYC/AML)
Creators are required to connect an active Stripe account and submit all required identity and payout information directly to Stripe. Identity verification and related compliance checks are performed by Stripe in accordance with applicable KYC/AML and payment-partner requirements. Anonymous creators and unverified Stripe accounts are not permitted to receive payments or payouts through the Platform.
7. Acceptable use and prohibited content
You agree not to use the Services to engage in illegal, harmful, deceptive, or abusive conduct.
Prohibited content and activities include, but are not limited to:
- Pornographic, sexually explicit, or adult content.
- Sexual services, escorting, or any form of prostitution-related services.
- Illegal goods, services, or activities.
- Content that infringes copyright, trademark, or other intellectual property rights.
- Hate speech, harassment, threats, violence, or extremist content.
- Fraud, scams, deceptive practices, or impersonation.
- Collecting or disclosing private or confidential personal information (for example, payment card data, government IDs, medical records) without permission.
- Spam, malware, or attempts to disrupt or compromise the Services.
We may (at our discretion) remove content, suspend or terminate accounts, withhold payouts, and/or issue refunds where necessary to protect users, the platform, or our payment partners.
8. Content ownership, licenses, and feedback
8.1 Your content
You retain ownership of your User Content. You grant Cappybara a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content as needed to operate, market, and improve the Services.
You represent and warrant that you have all rights necessary to post your User Content and that it does not violate these Terms or applicable law.
8.2 Our content
The Services (including branding, software, design, and other materials) are owned by Cappybara and are protected by intellectual property laws. You may not copy, modify, reverse engineer, or distribute our Services except as permitted by law or with our written consent.
8.3 Feedback
If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation.
9. Copyright complaints (DMCA or similar)
We respond to properly submitted notices of alleged copyright infringement and may remove or disable access to content. Repeat infringers may have their accounts terminated.
10. Third-party links and services
The Services may contain links to third-party sites or services. We do not control or endorse them and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access at any time for any reason, including for suspected fraud, risk, compliance concerns, or violations of these Terms.
Termination does not necessarily remove Content that has already been shared publicly. We may retain information as required by law or for legitimate business purposes.
12. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
We do not guarantee that Creator Content or benefits will meet your expectations, that payments will be error-free, or that the Services will be uninterrupted.
13. Limitation of liability
To the maximum extent permitted by law, Cappybara will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses arising from or related to your use of the Services.
14. Indemnity
You agree to defend, indemnify and hold harmless Cappybara, Our subsidiaries and affiliated companies, and Our officers, directors, employees, partners, contractors, representatives, agents, and third party providers from and against any and all claims, causes of action, damages, obligations, losses, liabilities, costs or debt, and expenses (including reasonable attorneys’ fees and costs) and all amounts paid in settlement arising from or relating to, breach of these Terms or violation of any applicable laws. We reserve the right, in Our sole discretion and at Our own expense, to assume the exclusive defense and control of any matter for which you have agreed to indemnify us, and you agree to assist and cooperate with us as reasonably required in the defense or settlement of any such matters.
15. Governing law and dispute resolution
These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located within the State of Delaware, and you hereby consent to the personal jurisdiction and venue of such courts.
Before filing a legal claim, you agree to contact us and attempt to resolve the dispute informally.
16. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will provide notice (for example, via the Platform or email). Continued use after changes become effective means you accept the updated Terms.
